Andy has more than twenty years of experience handling regulatory matters in the fields of environmental permitting, energy regulation, and public utility law. In his current practice, he represents a wide range of clients in heavily-regulated industries, including renewable energy developers and telecommunications companies.

Andy thrives on the details of large, complex proceedings that involve highly technical, scientific, and environmental considerations. He relies on his extensive experience working at both state and federal regulatory agencies to help clients navigate permitting and government-oversight issues.

Andy takes a systematic and collaborative approach to meeting his clients' needs. Starting with the initial fatal-flaw analysis, he works with clients to map out the legal framework, risks, needs, and costs of their projects, from pre-permitting studies through post-approval regulatory filings. At the same time, Andy assists clients with the myriad collateral issues that invariably arise, such as due diligence for financial closings, tax determinations, property interests, and power purchase agreements.

Andy has had the good fortune (and fortitude) to be on the leading edge of commercial-scale wind energy and solar energy development in Vermont, which gives him no small measure of personal satisfaction. He is also increasingly involved in work for clients in the telecommunications industry, representing them in regulatory and court proceedings and advising them on many aspects of regulation in this rapidly evolving sector.

Whether working on a large-scale renewable energy project for a multinational company, or a property boundary dispute for an elderly Vermonter, a few common threads run through Andy's practice: dealing with clients and other parties in a human and personal way, using the legal system efficiently and fairly, and helping to achieve clients' objectives through a close understanding of regulatory systems and governmental decision-making at the local, state, and federal levels.

Before joining the firm, Andy served as general counsel to the Vermont Agency of Natural Resources, worked as a staff attorney in the field of public-utility regulation for the Vermont Department of Public Service, served on the board of the City of Burlington Electric Commission, and worked as a regional attorney for the U.S. Environmental Protection Agency, handling Superfund negotiations and litigation.

Renewable Energy & Clean Technologies

  • Representing and advising clients in all aspects of developing commercial- and consumer-scale renewable energy projects, including Public Service Board proceedings; state environmental and other permitting; federal environmental, FERC, and FAA requirements; sales- and property-tax issues; power purchase agreements; and financial due diligence.
  • Successfully permitted the first (and to date largest) wind energy and solar energy projects in Vermont.

Telecommunications

  • Assisting clients in regulatory proceedings at the Public Service Board and related legal proceedings in state and federal courts—matters include interconnection agreements, VoIP regulation, Eligible Telecommunication Carrier designations, and other aspects of retail and wholesale phone regulation.

  • Represented a regional planning commission in land-use permit proceeding regarding the expansion of a landfill in close proximity to a U.S./Canadian water body, negotiating a special post-closure fund to benefit the watershed.
  • Represented a group of homeowners in a land-use permit proceeding regarding the creation of a gravel quarry.

Government Relations & Public Policy

  • Providing input to Public Service Board and other regulatory bodies regarding proposed regulations, procedures and other guidance documents.
  • Drafting and commenting on pending legislation in the energy, environmental, and telecommunication fields.

  • Representing the interests of an owner of old mill property regarding electric and water power rights stemming from 19th and early 20th century agreements.
  • Represented a private landowner in a municipal proceeding to move an old public right-of way away from her historic home.
